These terms govern your access to and use of zachyurchuck.com. By using this website, you agree to these terms. If you do not agree, please do not use the site.

All website content is educational and informational only. It does not constitute legal or financial advice and should not replace advice based on your specific facts. Viewing or contacting this site does not create a lawyer-client relationship.

Do not act or refrain from acting solely on website content. Seek appropriate professional advice where required.

2. No lawyer-client relationship

Your use of this site, an email, a contact-form submission or a preliminary conversation does not make you a client of the firm. A lawyer-client relationship is formed only when the firm has completed conflict and suitability checks and both you and the firm enter into a written retainer agreement.

Until then, information you send may not be treated as confidential or protected by solicitor-client privilege. Do not send confidential, urgent or time-sensitive information through the website. We do not accept service of legal documents through this site or a general email address.

3. Permitted and prohibited use

You may access this site for lawful, personal or internal business information. You must not interfere with its operation or security; attempt unauthorized access; introduce malicious code; scrape or harvest information by automated means; impersonate another person; use the site for unlawful, misleading or abusive communications; or reproduce content in a manner that suggests our endorsement.

We may restrict or end access when we reasonably believe use is harmful, unlawful or inconsistent with these terms.

4. Intellectual property

The selection, arrangement, writing and visual design of this site are owned by or licensed to Zach Yurchuck Law and are protected by applicable intellectual property laws. You may print or save a reasonable copy for personal, non-commercial reference. Any other reproduction, adaptation, publication or distribution requires prior written permission, except as permitted by law.

Names and marks belonging to third parties remain the property of their respective owners. No licence is granted except for the limited permission to use the site under these terms.

Links to social networks, government resources or other third-party sites are provided for convenience. We do not control third-party content, availability, security or privacy practices, and a link does not imply endorsement. Your use of another site is governed by its own terms and policies.

6. Availability and limitation of responsibility

The site and its content are provided on an “as available” basis. To the extent permitted by law, we disclaim warranties regarding uninterrupted access, accuracy, fitness for a particular purpose and freedom from harmful components. You are responsible for using reasonable security precautions.

To the extent permitted by applicable law, the firm and its personnel will not be liable for loss arising from reliance on general website content, inability to access the site or use of a linked third-party resource. Nothing in these terms excludes responsibility that cannot lawfully be excluded, or limits duties owed to a client under an executed retainer.

Our Privacy Policy describes how personal information associated with this website may be handled. Electronic communication carries risks and may be delayed, intercepted or misdirected. A message is not considered received until a member of the firm acknowledges it.

8. Manitoba law

These terms are governed by the laws of Manitoba and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Subject to any rights you may have under mandatory law, disputes relating to this website or these terms will be submitted to the courts located in Winnipeg, Manitoba.

If any provision is unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions will continue. A delay in enforcing a term is not a waiver.

9. Changes and contact

We may update the website and these terms from time to time. Changes take effect when posted with a revised effective date. Continued use after a change means you accept the revised terms.
